I have a question. I have a student visa now from last 4 years and before these student visa I started a small business in India. i didnt expected it to grow much but now it has grown. I have used money from that business for my 2nd MS which is not completed yet
Here is the problem
I am getting married in May. Till May I can stay here legally but than once I leave and get married I want to come with my Wife. So I have 3 options
She apply alone for visitor visa ( chances are less for these)
She come as dependent ( I dont have any income here or any source of income from college)
I leave my student visa and we both apply for visitor visa. These option has a lot of risk but its the best I am thinking as I am not interested in going to college anymore
What you think which route I should take?

You can port to a new employer after your 485 has been pending for six months (from the date USCIS recieved your application). See IV threads on portability for more information.

I am preparing to apply for my EAD througth E-file online. I am on H1-B currently and my I-485 was filled under my husband's EB2 application in July 2007. I did apply for EAD at the same time and got approved EAD for a year but never used and it it expired in December 2008. Now My H-1 B cap will reach in March 2011 and want to go on EAD ASAP so I can save the remaining time on H1-B ( advised by my company lawyer.) . My questions -
Should I apply for reneal of EAD or new EAD?
How difficulat is it to apply online? Do I need to send coyp of my H1-B etc as supporting deocument?

As all PD are now current, number of EAD filling will increase. So the processing time will be about 6 months for EAD.
My question is what will happen, if the PD retrogress before EAD is approved. Will it be still approved, or will have to wait till PD get current again.

What docs are required for re-entry of spouse on H4 visa. The primary applicant on H1 is not travelling.
1. Copy of I-797 of H1 visa holder.
2. Passport copy of H1 visa holder.
3. Recent pay stubs of H1 visa holder.
3. Marriage Certificate.
Am I missing something.

Not sure you need any of 2, 3 or 4. However, it is very helpful to have a letter from the H1 employer saying that you are still employed by your company or whatever you work for and your spouse is currently on an H4 dependents visa.
My husband has found this has been adequate on many occasions.

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.
1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.
2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?
3. If company A cancels the 140, still can I able to port the PD ?

If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

Can someone explain how the lawyer files I-485(Does she e-file? or mail it to USCIS?) and how we know about it? How long does it take to know you have filed it? and how do we know about it?Lawyer mail the package to USCIS. Good lawyer tell their client tracking number and then send email with case numbers and copies of receipt notices.

Can someone tell me what to expect after things are in place? Like expecting Receipt date, fingerprinting - how many of them, what to look for and what to watch out for etc. A consolidated discussion may help many who are unaware of the system.

In normal circumstances (without the floodgates open) you would get a receipt within 2-3 weeks after the application is submitted. Fingerprinting happens soon after (still within a month). Then you get an EAD first, then the AP. In all this your lawyer will be informed as well as you. Sometimes your lawyer gets to hear first b4 you.

If yes, on whose name should we register the company ? Should I register on my name or is it anyway safer to register on my wifes name?

As I understand the process, if your date is current, the USCIS will accept your application - meaning they ARE processing applications with a priority date matching or exceeding yours.
During the July 2007 fiasco, the cut-off dates were current, allowing everyone to apply. If we submitted our application and the date is current at the time, why do we have to wait until our date becomes current again? Shouldn't they process the application within 6 months or less?
You application will continue to be processed when it is within the processing time - visa allocation happens only when your PD is current, which apparently is not. Moreover - Visa Bulletin is just a Forecast based on current demand so, actuals can vary at any time. There is so much to read about this in many forums including this, so you may want do more research before asking - I have a reason to tell you this because your poor soul will soon be hounded by GURUS for not researching enough :-) Hope you understand!

I was in similar situation during 2006. I applied for H1 1 year extension based on PERM approval. My LC was just 1 month old . Then premium processed my I-140, once I had my I-140, I then premium processed my H1 extension based on approved I-140. Finally got 3 year extension.

My spouse recently started working on F1 OPT. She also got her H1 approved (port of entry was requested and not change of status). H1 was through lottery to start from oct upon stamping. Suddenly our PD moved forward and we will file 485 next month.
We are going to India in dec. By that time we should get our AP. My question is does my wife need to go for H1 stamp or can she enter using her AP and keep H1 status. Both of us have different employers. Her 485 will be filed as my dependant.
Secondly - I will also get a new EAD. Can I work second part time job using that ead while maintaining my permanent job using H1?

You can re-file a denied I-140. In my case, first I-140 was denied in 2006 but never received the denial notice, so time for appeal lapsed. However, during 2007 July, we concurrently filed using the same labor. The second I-140 was approved in 2009. Both the I-140s were processed by Nebraska Service Center.
Hence, based on my experience, you can refile but you should be able to over come or at least have strong enough reasons to over come the cause of initial denial.
I am not sure on how to deal with with-drawl of your existing appeal and 485 petitions.
As far as 180 day rule of labor is concerned, my understanding is that, based on USCIS clarification, it only applies to initial filing of I-140 petition but not for re-filing as long as the original I-140 was filed with in permitted time. You can go through websites of Murthy / Rajiv Khanna for authentic information on this.
