The American Competitiveness and Workforce Improvement Act (ACWIA), imposes annual reporting requirements on U.S. Citizenship and Immigration Services (USCIS) concerning the countries of origin and occupations of, educational levels attained by, and compensation paid to, aliens who were issued visas or otherwise provided nonimmigrant status under H1B Visas (http://www.h1b.biz/lawyer-attorney-1137085.html) during the previous fiscal year.
Here are some highlights from the report submitted by USCIS earlier this year:
� The number of H-l B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) filed decreased 15 percent from 288,764 in Fiscal Year
2008 to 246,647 in Fiscal Year 2009.
� The number of H1B petitions approved decreased 22 percent from 276,252 in Fiscal
Year 2008 to 214,271 in Fiscal Year 2009.
� Approximately 48 percent of all H1B petitions approved in Fiscal Year 2009 were for
workers born in India.
� Two-thirds of H1B petitions approved in Fiscal Year 2009 were for workers between the
ages of25 and 34.
� Forty-one percent of H1B petitions approved in Fiscal Year 2009 were for workers with
a bachelor's degree, 40 percent had a master's degree, 13 percent had a doctorate, and 6
percent were for workers with a professional degree.
� About 41 percent of H1B petitions approved in Fiscal Year 2009 were for workers in
computer-related occupations.
� The median salary of beneficiaries of approved petitions increased to $64,000 in Fiscal
Year 2009, $4,000 more than in Fiscal Year 2008.

My employer will not withdraw my I-140. Should I still go ahead with AC21 or should I just do change of address with USCIS?
I will be starting my new job pretty soon. Any useful suggestions appreciated.

Its not necessary. however if you ever get a RFE, you have to be ready to respond with your AC21 docs. For the Address change, you can submit online by filling the AR-11 form.

If this has happened to you personally then you may be able to let Ombudsman know about it.
if it has happened to a friend of yours then maybe you can convince the friend to complain to Ombudsman.
Beyond this I doubt there is much that can be done.

Will the Visa numbers from fiscal year 2008 be used for alloting the numbers for those who are filing now ?
As per rule since those visa numbers are from future they cannot be alloted to those filing now.
Any predictions on how the October bulletin looks like ?

Hi,
My I-140 will be approved shortly in premium processing and I'll be applying for 3yr H1 extension. There is a chance that I may get laid-off soon and I wanted to know if I can change the jobs while my H1 extension petition is pending with USICS. My current H1 will expire in June'07.
Sorry, if I am asking a question that has already been addressed here. I tried to browse the forum but could not find anything.

Hi,
My L1 and I-94 is valid till August 14th 2009 -- I want to know if I can travel India and come back before it is expired. Are there any restrictions on port of entry when visa is nearing to expire. I would not take chance if there is a porblem in international travel and if I have deportation issues at the point of entry then I am not willing to go. But I want to visit my parents as they are not doing well.
Also, I am thinking once I am back from India then I can apply for L1 visa extension -- is it a good idea to apply for extension after I come back or I can apply and go to India for vacation.
Please guide me as I am in a fix and I am not able to take any decession.

As far as I know when I was in school getting my PhD (2003-2006) they had introduced a new rule saying that you could only get another OPT when you go for a higher degree. Example I did MS, use my OPT. If I go for higher degree like PhD I will get another OPT but if I go for another Masters I will not get an OPT since I used mine during first Masters. But please check with the rules in the school (contact the International Office and verify this).
You will be subject to cap if you come out of school and apply for non-profit job.

to port ur PD u shoudl have ur 140 approved from the first filing!
You can port PD only by sending in the previous approved 140 with the new 140 and request for interfiling!

I applied 485 on july last year when all PD were current.

Also Obamaji its gr8 that you put additional fee on H1B so that you can protect border crossing. How about putting the additional penalty on people employing undocumented folks? You could not even bring the CIR on the floor but you were able to pass penalties against skilled workers so quickly.

Thanks for the reply.But in my H1-B petition the DOB is correctly enetered.In my H1 stamping(Visa) the DOB is not correctly enetered.When i went to Driving licence office they checked my passport DOB and Stamped VISa DOB.and they asked me to get the DOB corrected in the Visa.one of my friend suggested me to goto INFOPASS and get it corrected.
Do u have any idea?

I have a valid H1B Visa which is expiring on Feb 16th, 2008 and my old H1 is expiring the same day as my Visa. I applied for my H1B extension my H1 extension is pending. I am planning to go to india on Dec last week and coming back on jan 7th.
1) Can I travel without any problems/
2) While coming back, what are the documents I need to show, will my old H1 is enough or do I have to show receipt of showing I applied for extension?
